Morning Harvest $10,000 Nest Egg Promotion 2016 – Terms & Conditions
1. These Terms and Conditions apply to the "Morning Harvest $10,000 Nest Egg" Promotion ("Promotion"). The promoter is Independent Egg Producers Co-Op Limited ("Independent Eggs"), c/- David Wynne Chartered Accountant Limited, 6a Vinery Lane, Whangarei, New Zealand. Independent Eggs reserves its rights to change these Terms and Conditions at any time and for any reason without notice. By participating in the Promotion, entrants agree to be bound by these Terms and Conditions.
2. Independent Eggs is giving entrants the chance to win one (1) main prize of NZ$10,000, consisting of one (1) NZ$10,000 cheque payable to the winner, and one of 10 additional runner-up prizes of Breville 2-slice toasters or such similar product as determined by Independent Eggs in its absolute discretion (details of which are set out in paragraphs 14 to 16 below) ("Prizes"). Winners of Prizes will be notified by email (to the email address supplied when completing the online entry) during the week following the competition closing, or such later date as determined by Independent Eggs if a Prize is to be re-drawn. If a winner is not able to be emailed in the week following the competition closing due to an incomplete entry, as determined by Independent Eggs in its absolute discretion, or fails to make contact within four (4) weeks of the notification email sent by Independent Eggs, the entrant will no longer be eligible to receive the Prize and another winner will be drawn. Independent Eggs reserves the right to redraw the prize.
3. The opening date for the Promotion is 16/8/2016 and the closing date is 23/10/2016 ("Promotion Period").
Entry of Promotion
4. You must be 18 years of age or over and a New Zealand resident to enter the Promotion
5. Information on how to enter forms part of the Terms and Conditions of entry. To enter the Promotion you must:
a. complete and submit the 'Morning Harvest $10,000 Nest Egg' competition entry form on the Morning Harvest Eggs website, www.morningharvest.co.nz, in accordance with the entry instructions included therein (including submitting the entry from an email address) within the Promotion Period;
b. correctly answer the question of skill on the 'Morning Harvest $10,000 Nest Egg' competition entry form on the Morning Harvest Eggs website, www.morningharvest.co.nz, within the Promotion Period; and
c. if requested by Independent Eggs, provide a receipt from New World, PaknSave or Four Square of any eligible Morning Harvest product purchased as proof of purchase.
6. Multiple entries are acceptable provided proof of purchase receipt can be provided to match the entry details completed online.
7. Entrants are identified by the email address used to submit the entry.
8. Only entries complying with these Terms and Conditions will be valid and eligible for a chance to win a Prize. Independent Eggs reserves the right to verify the validity of any entry and reserves the right to disqualify any entrant who Independent Eggs believes has tampered with the entry process, acted in a fraudulent or otherwise dishonest manner (including for submitting inappropriate or offensive material), submitted an entry that is not in accordance with or breaches these Terms and Conditions, or for any other reason Independent Eggs deems appropriate.
9. Employees of Independent Eggs, any agency associated with the Promotion or any related company of Independent Eggs and any family members of those employees are ineligible to enter.
10. Any Prize won by drawing a winner whose entry was received by email will be awarded to the person whose name appears in the email address from which entry was submitted, or who provides evidence satisfactory to Independent Eggs that the email address from which the entry was submitted belongs to him or her.
11. Independent Eggs takes no responsibility for disputes arising as a result of entries submitted by entrants using an email address belonging to any other person or an entry being incorrectly submitted.
12. Proof of online entry will not be taken as proof of receipt of the entry by Independent Eggs. Independent Eggs takes no responsibility for lost, damaged, misdirected or late entries, incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access telecommunications network services, or any other error or malfunction or inability to enter the Promotion.
13. Independent Eggs reserves the right to disqualify any entrant in its absolute discretion and without giving reasons.
Prizes
14. There will be only one (1) main prize of NZ$10,000 and 10 additional runner-up prizes of Breville 2-slice toasters, or such similar product as selected by Independent Eggs in its absolute discretion. Winners will be drawn from all valid entries received during the Promotion Period prior to the main draw.
15. Prizes are not transferable and cannot be exchanged for cash.
16. Independent Eggs reserves the right to substitute any Prize with another prize of similar value without prior notice. Independent Eggs shall not be liable if, for any reason outside its control, any prize or part of any prize becomes unavailable.
Drawing of winners
17. Winners of the Promotion will be determined by Independent Eggs by random draw the week after the end of the Promotion Period and winners will be notified by Independent Eggs by email.
18. The winners will be chosen at random by Independent Eggs. Independent Eggs' decision on the winners is final.
19. In all cases Independent Eggs' decision is final and no additional correspondence will be entered into.
General
20. Independent Eggs and its associated agencies or related companies shall not be liable to any person in any way (including, without limitation, in negligence) for any loss, damage or personal injury whatsoever suffered or sustained or any liability or cost incurred (including, without limitation, indirect or consequential loss) as a result of or in connection with participating in the Promotion, acceptance, possession, use or misuse of any Prize. Independent Eggs is not liable for any tax implications that may arise as a result of winning any prize. By participating in the Promotion, each entrant releases, discharges, indemnifies and holds harmless Independent Eggs and its associated or related companies for any such damage, loss, injuries or liability to person or property.
21. Independent Eggs accepts no responsibility for any Prizes damaged or lost by a courier company or New Zealand Post (if applicable), as a result of an incorrect address being provided to Independent Eggs or if a Prize is lost after the Prize is delivered to or collected by a winning entrant.
22. Independent Eggs respects privacy rights under the Privacy Act 1993 and is required to comply with the privacy principles in respect of collection of personal information from individuals. Independent Eggs collects and holds personal information provided by each entrant in order to conduct the Promotion (in particular to notify Prize winners and to verify Prize winners' identities) and for the purpose of future marketing and promotion of relevant products and services to entrants from time to time. All personal information provided by entrants will be held by Independent Eggs at such place as is notified to an entrant on request. Under the Privacy Act 1993, all entrants have the right to access and correct their personal information. Please direct all such enquiries to Independent Eggs.
23. Entry into the Promotion constitutes consent by the winner for Independent Eggs to publish the winner's name on the Morning Harvest Eggs website competition page, www.morningharvest.co.nz and such other places as Independent Eggs wishes to publicise winners' names.
24. Winners agree to be available for reasonable promotional and publicity purposes.
25. Independent Eggs reserves the right to modify, terminate, suspend or reschedule the Promotion at any time and accepts no responsibility if such event occurs.
26. These terms and conditions shall be governed by and construed in accordance with the laws of New Zealand and shall be subject to the exclusive jurisdiction of New Zealand Courts.
